سياسة الخصوصية

المقدمة

The use of electronic services provided for in this agreement shall be subject to the terms and conditions set forth herein below:

مواصفات وقيود كلمة المرور:

– The minimum password is 8 letters and numbers, and the maximum is 20.

– A password must be composed of uppercase and lowercase letters as well as special characters.

- يجب عدم تكرار نفس الحرف / الحرف 3 مرات ولا يجب أن يكون متتالي مثل (111 أو aaa).

- يجب ألا تحتوي كلمة المرور على أي مسافات.

- يجب ألا تكون كلمة المرور واسم المستخدم متماثلين.

- يجب عدم إعادة استخدام آخر 5 كلمات مرور تم استخدامها من قبل.

1. The Bank won’t be liable for any losses resulting from sharing the client’s credentials with a third party.
2. The Customer acknowledges and agrees that he/she alone bears the full liability for the correctness and accuracy of the information and instructions, including payment instructions given through the Bank’s Application for electronic banking services, i.e. “Warba Bank’s Application.”
3. يجيز العميل للبنك بالتصرف وفقًا للتعليمات التي يتلقاها من العميل نفسه بخصوص الخدمة على مسؤولية العميل. علاوة على ذلك ، يوافق العميل على تعويض البنك عن جميع الخسائر الفعلية التي قد يتكبدها البنك نتيجة لتلك التعليمات.
4. The Bank has the right to refuse to perform and enforce any instructions provided by the customer without giving any justification, for example if transactions are not compliant with applicable laws, Sharia legitimate transactions, anti-money laundering instructions or CBK instructions etc. applicable in the State of Kuwait. The Bank does not assume any responsibility, whatsoever, in the event of failure to perform and carry out any instructions from the customer due to technical problems.
5. The Bank may, at its absolute discretion, amend or change any of the terms and conditions, including the limits on transfers at any time without need to get the consent of the customer. Such new terms and conditions shall come into force after 7 days of customer receipt of a notification from the Bank of the said amendments. If the customer must accept the amendments in the terms and conditions in order to be able to use the services provided by Warba Bank
6. التحويلات التي تتم خلال ساعات العمل قبل 11:30 سيتم إجراؤها في نفس اليوم. سيتم إجراء المعاملات التي تتم بعد ساعات العمل الرسمية أو خلال عطلة نهاية الأسبوع والعطلات الرسمية للبنك في يوم العمل التالي ، باستثناء التحويلات بين الحسابات الشخصية أو الحسابات الأخرى في بنك وربة والتي سيتم إجراؤها في نفس اليوم.
7. يوافق العميل ويتعهد بالحفاظ على سرية اسم المستخدم وبيانات الاعتماد للخدمات الإلكترونية "تطبيق بنك وربة" ، سواء الصادرة عن البنك أو التي أنشأها العميل.
8. The customer agrees and undertakes to maintain the confidentiality of the username and credentials for electronic services “Warba Bank’s Application,” whether issued by the Bank or created by the customer.
9. The customer agrees that he/she alone shall bear the full responsibility for any actual loss or harm as a result of misuse of the personal number of the ATM card or any other card and the PIN created by the customer himself or by any other user whether authorized or not authorized to do so. Accordingly, the Bank will not be responsible for any unauthorized or fraudulent attempt to use the personal number and PIN for the ATM card or any other card.
10. يقر العميل ويوافق على أنه بمجرد قبوله لشروط وأحكام الخدمات المصرفية الإلكترونية ، عند تسجيل الدخول إلى تطبيق بنك وربة للخدمات المصرفية ، يعتبر العميل قد قام بمراجعة البنود والشروط الخاصة بالخدمات وقراءتها والموافقة عليها. أو المعاملة المطلوبة ويوافق العميل أيضًا على الامتثال والتصرف وفقًا للشروط والأحكام.
11. يجوز للبنك إنهاء هذه الاتفاقية في أي وقت عن طريق إخطار العميل بالطريقة التي يراها البنك مناسبة للاتفاقية دون إبداء أي أسباب لإنهاء العقد ودون تحمل أي التزامات نتيجة لهذا الإنهاء.
12. تخضع هذه الاتفاقية لقوانين دولة الكويت. تخضع كل الشروط والأحكام للاختصاص القضائي لمحاكم الكويت دون الإخلال بأحكام الشريعة الإسلامية.
13. In the event of any conflict between the Foreign Languages and the Arabic texts, the Arabic version shall prevail and be used as reference.
14. تحسب رسوم المعاملات التي تتم باستخدام تطبيق بنك وربة وفقًا لقائمة تعريفة معتمدة في البنك. يوافق العميل على خصم جميع الرسوم من حسابه في البنك. يجوز للبنك تعديل هذه الرسوم وتغييرها بعد الإعلان بأي وسيلة يراها مناسبة.
15. All copyrights and other intellectual property rights on this Warba Bank’s Application are the exclusive property of the Bank, including but not limited to all design, text, audio recordings, images, or communications, except as expressly stated. Therefore, these may not be copied, moved, published, performed or announced, retrieved, applied or distributed, displayed, licensed, changed or linked through the Internet, or otherwise used in whole or in part in any way whatsoever without the prior written consent of the Bank.
16. يلتزم العميل بالحفاظ على سرية معلوماته المصرفية ، والتي تمكنه من تسجيل الدخول إلى تطبيق بنك وربة عبر الإنترنت لمنع الوصول الغير المصرح به. ننصح العميل بالاحتفاظ بهذه المعلومات في مكان آمن كإجراء احترازي. وهذا دون ادنى مسؤولية على البنك.
17. يجب على العميل إبلاغ مركز الاتصال بالبنك على الفور بفقدان معلوماته أو عندما يتم استخدام هذه المعلومات من قبل مستخدم غير مصرح له. يحتفظ البنك بالحق في منع الوصول إلى تطبيق بنك وربة ، للحفاظ على أمان تطبيق البنك والأنظمة المصرفية الأخرى في حالة شك البنك في الوصول إلى معلومات العميل أو استخدامها من قبل شخص غير مصرح له.

معلومات العميل

We draw the attention to the fact that the information sent over the Internet is vulnerable to interception, intrusion or surveillance. Thus, the customer declares his knowledge of this risk and therefore accepts the risks of online information exchange. Without prejudice to any provision of this Agreement, the Bank does not assume any liability for any loss of whatever nature arising from or in connection with exchanging information. However, the Bank provides encryption technology and takes other procedures that are appropriate and necessary to ensure adequate protection of information provided or received by the Bank over the Internet.

جميع المعلومات والبيانات المقدمة هي ملك حصري للبنك. يجوز للبنك استخدام هذه المعلومات أو الأفكار أو المفاهيم أو الخبرة أو التكنولوجيا لأي غرض يراه مناسبًا.

 

شروط الاستخدام العامة

1. يوافق العميل ويقبل ويقر بأن الاستخدام الأول للخدمة من قبل أي مستخدم يشكل قبولًا من قبل العميل واتفاقًا غير مشروط ملزم لكلا الطرفين بموجب هذه الشروط والأحكام.
2. لن يكون البنك مسؤولاً عن أي التزام مالي ، بما في ذلك على سبيل المثال لا الحصر ، تكلفة الخسارة أو الأضرار أو رد الأموال الفوري الناشئة عن عدم تحديد المستفيد بشكل صحيح أو عدم تسوية المدفوعات بسبب أي خسارة أو سرقة أو عدم تنظيم الاشتراك أو الخطأ أو السهو أو التلف أو التشويه.
3. يحق للبنك رفض أي طلب وأية تعليمات عبر الإنترنت ولا يجوز له الاستمرار في تقديم الخدمة كليًا أو جزئيًا دون إبداء أي أسباب.
4. لا يتحمل البنك أي مسؤولية في حالة فشل أي من وكلائه في الوفاء بتاريخ القيمة بسبب ضيق الوقت أو اختلاف التوقيت في المناطق أو العطلات المحلية أو لأي سبب آخر مهما كان نوعه.
5. The Bank may reject or cancel any transaction if such transaction is incomplete or not matching, incorrect or inconsistent with any applicable legal regulation or due to not updating customer data with the Bank.
6. Money transfer requests received before the end of the banking day shall be issued on the same day. The available balance in the account should be sufficient to cover transaction at maturity date. The Bank is not obliged to notify the customer in case the Bank is unable to execute the transaction because of insufficient balance in the account.
7. يوافق العميل على وسائل الاتصال المختلفة مثل الإخطارات والمعلومات الإلكترونية الأخرى بما في ذلك على سبيل المثال لا الحصر, أي إشعارات أو معلومات ترويجية لتفاصيل الاتصال التي يقدمها العميل للبنك. يجب على البنك الاعتماد على معلومات الاتصال هذه والنظر في الرسائل المرسلة إلى هذا العنوان على أنها مستلمة بشكل صحيح حتى يقدم العميل أي عنوان جديد.
8. The Bank shall give customers access to the banking services without prejudice to the Bank’s application policies and procedures for avoiding loss or damage that may arise as a result of the use of this service.

The Bank may, at its own discretion, take advantage of one or more external service providers, agent / agents in accordance with these terms and conditions as necessary for its products / services.

التزامات البنك تجاه العميل:

1. 1. توفير موقع إلكتروني متوافق مع أحدث الأنظمة والمعايير المحلية.
2. 2. يضمن سلامة وسرية تعليماتك ومعاملاتك على الإنترنت.
3. يتبادل المعلومات نيابة عنك. لا يُتوقع منك أو يُطلب منك الاستفسار عن سلطات أو سلطات الأشخاص المسؤولين.
4. تنفيذ التعليمات التي تلقيتها عبر تطبيق بنك وربة وفقًا لسياسات وإجراءات البنك الطبيعيه.

المسؤولية عن الضمانات

يوافق العميل بشكل بليغ على استخدام الموقع وتحمل المخاطر الناتجة عن استخدام الإنترنت. يجب توفير هذا الموقع على أساس "كما هي" و "حسب توفرها".

– Except as mentioned above, the Bank does not assume any responsibility for any kind of guarantees, either express or implied or statutory, including, implied warranties of merchantability or appropriateness for a particular purpose or data accuracy and completeness or any guarantees associated with the violation of online banking service.

– The Bank does not guarantee uninterrupted access to the site and banking services over the Internet, “Warba Bank’s Application”, and does not guarantee timely access or safe access or error – free access. Further, the Bank does not offer any guarantees on the results that can be obtained from the site, or any other intermediary, in respect of the accuracy or reliability of the Internet banking service.

– The Bank does not assume any responsibility for any electronic virus attacks that may infect the user applications system as a result of using the online banking service. The Bank does not guarantee to the user or any other third party that the Internet Banking service “Warba Online” is viruses-free.

تحديد المسؤولية

Except as stated in this Agreement or as provided under law, the Bank does not assume any responsibility for any injuries or damage, whether direct or indirect, special or consequential resulting from the banking services over the Internet, “Warba Online” or any use of the service, or that may arise due to installing, running, uninstalling or maintaining the customer application own computers software.

الإنفاذ بشروط الاتفاقية

تسري أحكام وشروط هذه الاتفاقية من تاريخ الموافقة عليها عبر الموقع الإلكتروني أو عبر قنوات البنك الأخرى.

التنازل

لا يجوز للعميل بموجب هذه الاتفاقية نقل أو التنازل عن الحقوق أو الالتزامات الناشئة عنها.

الموافقه

أتعهد بأنني قد قرأت وفهمت الشروط والأحكام المذكورة أعلاه وأوافق على الامتثال لهذه الشروط باعتبارها عقدًا ملزمًا يجب الامتثال لشروطه وإنفاذها.
